THE CODE OF CONDUCT FOR
JOCKEYS' SPONSORSHIP
1. INTRODUCTION
1.1 Phumelela Gaming and Leisure Limited and Gold Circle
Racing and Gaming Group and their subsidiaries and affiliates ("Phumelela
and Gold Circle") conduct the business of holding race meetings for
thoroughbred horse races in the Republic of South Africa in accordance with
the rules and regulations of the National Horseracing Authority and in
accordance with other conditions of participation which it publishes from
time to time ("the local conditions").
1.2 It is one of Phumelela and Gold Circle's local
conditions that all sponsorship rights in respect of the race meetings and
the related activities which take place at the venues at which Phumelela and
Gold Circle hold the race meetings are reserved in favour of Phumelela and
Gold Circle; and that no jockey may carry any form of advertising material
on any part of his clothing or equipment save to the extent approved by
Phumelela and Gold Circle.
1.3 This document sets out the terms and conditions on
which the jockeys who participate in race-meetings held by Phumelela and
Gold Circle may carry sponsorship and advertising material on their clothing
and equipment.
2. THE SPONSORSHIP SITES
A jockey shall be permitted to carry sponsorship only on
the following items of riding equipment and only to the extent set out below
and depicted in Appendix 1:
2.1 Breeches
2.1.1 Outer thighs - One site on each outer thigh,
between the hip and the knee, each site to be identical and no more than
250cm2 in size;
2.1.2 Coccyx - One site, at the base of the spine, on the rear of the
breeches, of no more than 70cm2.
2.2 Jockeys Clothing
The neck - One site, on the [stock] centre front
of the neck of the garment worn underneath the owners' silks, of no more
than 45cm2 in size.
2.3 Jockeys Boots
One site on the outer side of each boot, each site to be
identical and no more than 250cm2 in size.
3. THE CONTROLLED AREAS
Any sponsorship carried by a jockey shall comply with the
provisions of this code when a jockey:
3.1 is in the pre-parade or parade ring at the
racecourse;
3.2 is on the racetrack;
3.3 is in the winners enclosure or any other unsaddling area at the
racecourse;
3.4 is mounted on a horse at the racecourse;
3.5 is in the weighing room at the racecourse;
3.6 is proceeding between any of the above locations at the racecourse.
4. TYPE OF SPONSORSHIP
A jockey shall not be permitted to advertise or carry
sponsorship in respect of the following:
4.1 the occult;
4.2 private investigations agencies;
4.3 commercial services offering advice on personal or consumer problems;
4.4 guns and gun clubs;
4.5 pornography;
4.6 any product or service which is inimical to or undermining of the
commercial interests of Phumelela and Gold Circle, including bookmaking or
other betting and gambling services and any product or service which could
reasonably be regarded as competing with the products or services offered by
Phumelela and Gold Circle;
4.7 any product or service in respect of which advertising is prohibited by
law.
5. LODGEMENT OF SPONSORSHIP CONTRACT
A jockey shall not be permitted to carry any sponsorship
unless all the rights and obligations of the jockey and the sponsor are
recorded in a written contract, in a form and content reasonably acceptable
to the South African Jockeys Association.
6. SPECIFIC EXCLUSIVITY ARRANGEMENTS
Notwithstanding anything to the contrary in this code, a
jockey shall not be permitted to advertise or carry any sponsorship at the
following events unless it has been approved by the race organiser and
sponsor:
6.1 the Summer Cup at Turffontein Racecourse;
6.2 the July Handicap at Greyville Racecourse
6.3 the Met at Kenilworth Racecourse
6.4 any event or series of events for which Phumelela and Gold Circle have
granted sole or exclusive advertising or sponsorship rights, provided that
Phumelela and Gold Circle shall not grant sole or exclusive advertising or
sponsorship rights where the investment value of such advertising or
sponsorship rights is less than R100 000 (one hundred thousand Rand) without
having first consulted with the South African Jockeys Association or its
successor-in-title.
7. CONSIDERATION
SAJA shall be entitled to receive 5% (five percent) of
all consideration payable by a sponsor to a jockey.
8. GENERAL
8.1 The permissions granted by Phumelela and Gold Circle are subject to the
rules and regulations of the National Horseracing Authority.
8.2 This code take will take effect for a period of 12 months after the
signing of the first jockey sponsorship contract, after which period it
shall be reviewed by the parties hereto.
